Elmhurst Setback Requirements

The following are the Zoning Requirements for new construction. Side yard setbacks are limited to 5 feet from the lot line to the eave, unless the builder has applied for and been granted a variance. The maximum variance is 20% of the required setback, or 1 foot. Chimneys are allowed to protrude into that space 12 inches.



7.4-3 Lot Size Requirements
a. Permitted Uses

Single-family detached dwellings
Minimum Lot Area: 7260 Sq Ft
Minimum Lot Frontage: 50 ft.

7.4-4 Maximum Lot Coverage
No building, together with its accessory structures, shall occupy in excess of 30 percent of the area of the lot upon which it is constructed.


7.4-5 Yard Requirements
a. Permitted Uses

Single-family detached dwellings
Front Yard: 25 Ft.
Interior Side Yard: 5 Ft. *
Corner Side Yard: 10 Ft.
Rear Yard: 25 Ft.

*However, on any lot which is not served by an alley and on which the main building does not have an attached garage there shall be provided a side yard on one side of the lot of not less than nine feet in width to allow for a driveway or parking space.


4.6-3 Permitted Obstructions in Required Yards
The following shall not be considered to be obstructions when located in the required yards specified:
a. In all yards.
Unroofed steps four (4) feet or less above grade which are necessary for access to a permitted building; unroofed terraces; chimneys projecting twelve (12) inches or less into the yard; arbors and trellises up to a maximum of 16' in length; flagpoles; and fences or walls subject to applicable height restrictions of Chapter 12.
b. In front and corner side yards.
One-story ground floor bay windows projecting two (2) feet or less into the yards; and overhanging eaves and gutters projecting 18 inches or less into the yard. Outside elements of central air conditioning systems may protrude 4 feet into the front or corner side yard provided they are effectively screened with hedges or a fence not greater than 3 feet in height.
c. In rear yards.
Recreational and laundry drying equipment; outside elements of central air conditioning systems, extending not more than four (4) feet into the yard; one-story bay windows projecting two (2) feet or less into the yard; and overhanging eaves and gutters projecting 18 inches or less into the yard.
Permitted obstructions and detached accessory structures shall not, in the aggregate, occupy more than 40 percent of any required yard.
